The exact professional title may differ from the one mentioned above. The level of education or licence may also be required. The source of professional compensation must come from outside Canada to be considered a business visit. When a Canadian employer is involved in the profession, it can obtain a work permit for up to three years. The application can be filed at a port of entry. The current NAFTA exemption code is T23, but it could change in the future if the USMCA is put in place. When processing applicants who request temporary entry in accordance with the post-sale provision of Appendix 1603.A.1, copies of the original contract for sale, warranty or service and renewals of such agreements are required. On July 7, 2020, the U.S.-Mexico-Canada Agreement (USMCA) replaced the North American Free Trade Agreement (NAFTA). The criteria for admission to the USMCA are the same as under NAFTA.
While the admission of EDTs under NAFTA has been governed by the list of professionals in Appendix 1603.D.1 of NAFTA Schedule 1603, TN`s admission under the USMCA is governed by the list of professionals listed in Chapter 16 of Schedule 2 of the ACCORD. The annexes are identical. Essential skills or services are specific qualifications that are essential to the effectiveness of the company`s Canadian business activities. In general, essential skills are held by specialists and not by ordinary skilled workers. The essential worker must not have been employed in advance by the American or Mexican company, unless the required skills can only be acquired by the work done for that company. With a few exceptions, each profession requires a bachelor`s degree as a condition of entry. If a bachelor`s degree is required, the experience cannot be replaced by that degree. In some professions, an alternative to a bachelor`s degree is mentioned.
For some trades, in addition to the diploma, experience is necessary. A comprehensive list of occupations with minimum requirements for education, vocational training and alternative qualifications is available in Appendix 1603.D.1 of NAFTA Chapter 16. That`s not to say that Trump was the only actor who didn`t get everything in his own way. For example, the Canadian delegation and the U.S. Chamber of Commerce were among the stakeholders who wanted the list of occupations covered by Chapter 16 to be expanded to include more technology and COMPUTER occupations that did not even exist when the original NAFTA was launched in 1994.
